Terms & Conditions

The Malibu Hotel


Please read carefully

By entering, remaining on, reserving accommodations at, or using any portion of the Malibu Hotel property, you acknowledge that you have read, understand, and agree to the following safety rules and conditions of entry. These terms apply whether or not you sign a separate document. If you do not agree, please do not enter or remain on the property.

1. General safety rules

For the comfort and safety of all guests, visitors, and staff, we ask that you:

  • Conduct yourself in a safe, lawful, and respectful manner at all times
  • Respect all instructions or commands made by hotel staff
  • Follow all posted signs, warnings, instructions, and hotel policies
  • Use hotel facilities only for their intended purposes
  • Supervise minors at all times; minors may not be left unattended in common areas
  • Avoid running, horseplay, unsafe conduct, or intoxicated behavior
  • Promptly report any unsafe or hazardous conditions to hotel staff

The Malibu Hotel reserves the right to refuse service or remove any person who violates these rules, without refund, to protect the safety of others.


2. Assumption of risk

You understand that staying at or visiting a hotel involves certain inherent risks. These may include, but are not limited to:

  • Slips, trips, or falls
  • Wet or uneven walking surfaces
  • Stairways, balconies, and common areas
  • Weather-related conditions
  • The actions or conduct of other guests

By entering the property, you voluntarily assume all risks associated with your presence, whether known or unknown, foreseeable or unforeseeable.


3. Release and waiver of liability

To the fullest extent permitted by law, you agree to release, waive, and discharge the Malibu Hotel, including its owners, managers, employees, agents, and affiliates, from any claims or liability arising from ordinary negligence related to:

  • Personal injury
  • Illness
  • Property damage or loss
  • Theft
  • Death

that may occur as a result of your entry onto or use of the property.


4. Limitation of liability

To the maximum extent allowed by law:

  • The Malibu Hotel shall not be liable for indirect, incidental, special, or consequential damages
  • Any liability, if established, shall be limited to the amount paid by the guest for the applicable stay
  • The hotel is not responsible for lost, stolen, or damaged personal property, whether located in guest rooms, vehicles, or common areas


5. Third-party responsibility

The Malibu Hotel is not responsible for the acts or omissions of third parties, including other guests, visitors, independent contractors, vendors, or service providers.


6. Medical responsibility

Guests are responsible for their own medical care and well-being. The Malibu Hotel does not provide medical supervision or treatment and assumes no responsibility for medical outcomes occurring on the property.


7. Consent by entry

You acknowledge that these terms are made available through posted signage, the hotel website, booking materials, or at check-in.
Entry onto the property constitutes acceptance, and continued presence confirms your agreement to these conditions.


8. Severability

If any portion of these terms is found unenforceable, the remaining provisions shall remain in full force and effect.


9. Governing law and venue

These terms are governed by the laws of the state in which the Malibu Hotel is located. Any dispute shall be brought exclusively in a court of competent jurisdiction within that state. Thank you for helping us maintain a safe and enjoyable environment for everyone.



10. Cancellation policy

We understand that plans may change. Please review our cancellation policy carefully prior to confirming your reservation. For reservations with a stay of six (6) days or fewer, if the reservation is canceled, the deposit is forfeited. For reservations with a stay of seven (7) days or more, if the reservation is canceled, a charge equal to 50% of the total reservation amount will apply. All cancellation charges will be applied to the payment method on file. This policy applies regardless of the reason for cancellation, including but not limited to travel delays, weather conditions, or personal circumstances, except where prohibited by law. By confirming a reservation at the Malibu Hotel, you acknowledge and agree to this cancellation policy.
